When do I need performance and payment bonds for public construction?
Two bonds, two different protected parties
A performance bond protects the owner. It promises the project gets finished, and it pays the owner if you fail to complete the contract.
A payment bond protects everyone under you. It guarantees that the people supplying labor and materials get paid, so a subcontractor or supplier does not have to sue your project to recover.
The two travel together on federal construction. A contracting officer may also demand additional bonds or security beyond the pair, so the contract, not the statute alone, sets the final list.

The $100,000 line that starts the requirement
Federal construction contracts of more than $100,000 require the pair before award. At or under that line, the Miller Act's own text does not force them.
The payment bond carries its own sizing rule. It generally equals the total amount payable under the contract, unless the contracting officer decides in writing that is impractical, and in any case it cannot be less than the performance bond.
Size matters for access as much as compliance. The bigger the contract, the bigger the bond capacity a surety must believe you have, and capacity is the ceiling most growing contractors hit first.

MaineDOT prequalification reads your bonding capacity
MaineDOT asks about the pair before you ever bid. The prequalification packet includes a bonding company statement of your capacity for a single project and in aggregate across all projects.
The annual renewal asks for the same. Letters go out in the fall requesting updated submittals, and the bonding statement travels with the safety and civil rights forms.
That is the mechanism in miniature: the state does not require the pair to let you bid, but it will only award to contractors passing the qualification requirements, and a surety's statement of your capacity is one of the documents it reads.

The SBA guarantee behind a thin file
A surety refuses more small contractors than it prices. The SBA guarantee program exists for that refusal, backing bid, performance and payment bonds issued by its partner sureties.
The reach is wide by bond standards: contracts up to $9 million non-federal, $14 million federal, for businesses that pass SBA size standards and the surety's own credit, capacity and character evaluation.
The fee is published, which almost nothing else on the bond chain is. Performance and payment guarantees carry a fee of 0.6 percent of the contract price to the SBA, refunded if the bond is cancelled or never issued. The bid bond page covers the no-fee guarantee that precedes this pair.

What the pair costs you every year you carry it
Bond cost is a premium, not a fee. It renews with the work, and it is underwritten against your whole financial picture, which is why the same contract prices differently for different contractors.
Two levers move the premium down over a career: financial statements worth reading, and completed projects that show. A surety pricing your third public job reads a different business than one pricing your first.
The premiums are spent win or lose, so they belong in the pursuit budget rather than the job budget. That budget is laid out on the cost of chasing a contract, and the wage floor that runs alongside the pair on public work is on the prevailing wage page.

Does Maine state construction require performance and payment bonds the way federal work does?
The state's general boards publish no blanket rule; each solicitation's packet sets its bond terms. MaineDOT does not require the pair to bid, but awards only to contractors passing qualification, and it reads a surety's statement of your capacity as part of prequalification.
Who can claim against a payment bond?
Persons supplying labor and material on the contract. The bond exists so a second-tier subcontractor or a supplier does not have to chase payment through the chain above them. Its face value is what makes that promise credible.
Is the SBA guarantee a subsidy that pays my premium?
No. It backstops the surety, so the surety can say yes to a small business it would otherwise refuse. You still pay the surety's premium, plus the 0.6 percent SBA fee on performance and payment guarantees.
Can I bid a job bigger than my bonding capacity?
On most MaineDOT construction contracts exceeding $300,000 you cannot be awarded without passing prequalification, and your capacity statement is part of that file. Elsewhere the surety simply declines, and a declined bond is a bid you cannot back.
